Employees of the University are classified as either Exempt or Non-exempt according to the provisions of the Federal Fair Labor Standards Act of 1938 (FLSA).
- Non-exempt employees, as defined by the FLSA, are not exempt from Federal overtime requirements and must, therefore, be paid one and one-half their hourly rate of pay for every hour worked in excess of 40 hours in a workweek. Generally, these are staff employees and are on the bi-weekly pay cycle (26 pay periods). Refer to policy #310, Overtime, for more information on the calculation of overtime pay. For the University’s workweek, refer to policy #802.
- Exempt employees are those who meet the law’s requirements for exemption from overtime compensation. Employees who qualify for exemption may be executive, administrative, professional, and outside sales employees, who meet certain tests regarding job duties and responsibilities and are compensated “on a salary basis” at not less than stated amounts. Generally, these employees are Administrators and are on the semi-monthly pay cycle (24 pay periods).
The University further distinguishes employees in the following ways:
